Road Transport (Working Time) Regulations 2005

All drivers, crew and travelling staff that fall within the European driver’s hour’s rules are including in these regulations. There is no opt-out from the main body of the regulations.

The main points of the regulations are as follows:-
  • Must not work more than 6 consecutive hours without taking a break
  • If working hours are between 6-9 hours working time should be interrupted by a break or breaks totalling at least 30 minutes
  • If working hours total more than 9 hours, working time should be interrupted by a break and breaks totalling at least 45 minutes
  • Maximum working hours performed in a week 60 hours
  • The average over the reference period should be no more than 48 hours
  • Night time limit of 10 hours in a 24hour period unless a collective/workforce agreement is in place to opt out to this part of the regulation

It is your responsibility to notify in writing Pegasus Staff Services of all hours worked for both Pegasus and any other hours performed within the road transport sector. If you need clarification how to record your working time hours speak with your office of registration. The regulations have been introduced to protect your safety and also that of the other roads users. The enforcement of the regulations is the responsibility of the DVSA (formally VOSA), they have the powers to take persistent offenders to court with a potential maximum fine of £5,000.

To maximise potential working hours Pegasus Staff Services have a policy that the reference period would be fixed period of 26 weeks and that would ask all drivers upon registration if they would like to opt-out of the 10 hour working limit in a 24 period for night workers.

Workforce Agreement For Mobile Workers

This Workforce Agreement is between Pegasus Staff Services Ltd and {{customer_name}} in accordance with the provisions of the Road transport (Working Time) Regulations 2005 which came into force on 4th April 2005 and apply to those mobile workers, subject to the provisions of the regulations.

It is agreed that Pegasus Staff Services Ltd and the employees will adapt the flexibility permitted by the regulations as set out below. This agreement will remain in force for a period of 5 years after the commencement date thereafter it will cease to have effect.

Reference Period: the reference period for the calculation of average weekly hours shall be as follows:

- Extended to 26 weeks and will have a start dated the first Monday in January and the first Monday in July.
Night Work: a night worker’s normal hour of work may exceed the limit of 10 hours in each 24hour period.

Sole Or Multi Engagement

Please indicate below whether your employment with Pegasus will be on a sole or multi engagement basis. In the case of multi engagement, you must supply Pegasus all other hours worked within the road transport industry.

If you have a record of your WTD (Working Times Directive) for the current period, please supply that information now. If you do not have this information, all previous weeks in the current period will be entered as zero hours.

If your circumstances change you must notify Pegasus without delay.

In order to stay compliant, we must check driving licences at the time of registration and subsequently every three months. The driver will be required to provide an authorisation code to Pegasus Staff Services Ltd to enable the company to check the licence on the DVLA website. This code can be obtained by the driver via https://www.gov.uk/view-driving-licence

I undertake to inform Pegasus of any convictions, suspensions, impending prosecutions or changes in medical state, which may affect my entitlement to drive or cause my licence to be endorsed or subject to conditions.

I undertake to ensure that I comply with all Drivers hours’ regulations and the use and return of tachograph charts.

Driver Responsibility

I {{customer_name}} accept responsibility for any fines (e.g. parking, speeding, bus lanes etc.) as well as associated administrative fees incurred by me whilst working for and on behalf of Pegasus Staff Services. I accept that Pegasus Staff Services may pay fines on my behalf and deduct the cost from any monies owed to me.

Technology

Many of our clients now use in-cab cameras both forward and rear facing. This technology is used to help monitor driver behaviour but more importantly offers video evidence that could be used to protect yourself from the accusation of causing traffic accidents etc.

Also, many vehicles are fitted with trackers for security and logistical reasons.

Please confirm that you are aware of the use of this technology and are prepared to use it.

48 Hour Waiver for non-mobile workers

The Working Time regulations 1998 (“the regulations”) require the Company to limit your average weekly working time to 48 hours unless you agree with the company that the limit shall not apply to you.

Pegasus Staff Services wishes to have an agreement with you. It proposes an agreement (which shall apply until terminated by notice) on the basis that:
  1. The 48hour limit on average weekly working time will not apply to you;
  2. You may terminate the agreement (so that the 48hour time limit would apply to you) by giving the person at Pegasus Staff Services whom you usually report to, 7 days’ written notice.
Under the Regulations, Pegasus Staff Services must keep records relating to your working time. This is the case whether or not you reach an agreement with the Company about waiving working time limits.

Upon your first visit to a site the Client should provide you with a site induction including specific health and safety guidance. The following are minimum standards you must follow.

Working Practices
  • You must not operate any item of machinery or equipment unless trained and authorised to do so.
  • You must use all machinery and equipment in accordance with instruction and training.
  • You must inspect all machinery and equipment prior to use and report any defect, to the client immediately.
  • You must undertake all duties as instructed.
  • You should familiarise yourself with any vehicle you are required to drive, prior to driving it, either by seeking information and instruction from the client or referring to information in the vehicle handbook.
  • Coupling and uncoupling should always be undertaken in accordance with information and training. Tractor unit and trailer brakes MUST be applied appropriately. Always double check application of park brakes. Never approach any coupling and uncoupling task if you have any uncertainty.
  • Always familiarise yourself with, and follow, general site rules and specifically loading bay procedures. NEVER reverse into, or pull off a bay on a red light unless you have received specific instruction from someone with authority at that site.
  • You must not undertake any task that you feel may put yourself or others at risk of injury.
Hazard/Warning Signs and Notices
  • You must comply with all hazard, warning and instruction signs and notices displayed on the premises.
Site Accidents
  • You must report all personal accidents to
    1. the Management of the location the accident occurred
    2. the Client’s management team
    3. Pegasus Staff Services Ltd, irrespective of how minor and ensure details of the same are entered into the
    4. accident book.
  • You must report any incident in which damage is caused to property, vehicles or equipment
Health
  • You must report any medical condition that could affect your safety or that of others.
  • You must ensure you are aware of, and follow the rules pertaining to the no smoking areas.
Emergencies
  • You must ensure you are aware of the emergency (Inc. Fire) evacuation procedures and location of your assembly point.
PERSONAL PROTECTIVE EQUIPMENT
It is important that you have the correct Personal Equipment (PPE) for the type of work you are carrying out. It is important that you protect yourself from the risk of injury at all times.
  • Always wear protective footwear
  • Always use gloves when loading/unloading
  • Always wear a hi-visibility vest/jacket in designated areas
  • Always wear a hard hat when people are working overhead or when working with restricted headroom or if a client requires
DRUG AND ALCOHOL ABUSE
  • Pegasus Staff Services strongly advises against drinking alcohol prior to or during any assignment. The effect of even a small amount of alcohol has been proven to significantly increase the risk of accidents.
  • If you are currently under any medication, including any medicines for colds, flu or hay fever, you must read the information provided and fully understand the side effected that these drugs may cause. If they in any way impair judgement or cause drowsiness you must not drive on an assignment.
  • If Pegasus Staff Services, its client or their customers consider that you may be under the influence of any drugs or alcohol, you will be removed from the assignment.
  • You will be interviewed by Pegasus Staff Services and your future with the company will be at the discretion of the Directors, who have a zero tolerance to drug and alcohol abuse when driving.

YOU MUST INFORM PEGASUS STAFF SERVICES OF ANY CHANGES TO YOUR HEALTH THAT MAY AFFECT YOUR ABILITY TO WORK.
NB: You may need to tell the DVLA about some health conditions. Ask your doctor if you are not sure your condition will affect your driving.
You must surrender your licence to DVLA if your doctor tells you to stop driving or if you don’t meet the standards for driving.

The contractor shall ensure the provision of adequate Employer’s Liability Insurance, Public Liability Insurance, Professional Indemnity Insurance and any other suitable policies of insurance in respect of the contractor and its staff during an assignment and shall make a copy of the policy available to the employment business upon request.

The contractor and the hirer must not form a direct business to business relationship without the express permission of Pegasus Staff Services.

Any changes to your self-employed status must be notified to Pegasus Staff Services Ltd with immediate effect.

The default position is that the Conduct of Employment Agencies and Employment Businesses Regulations 2003 will apply unless the Limited Company Contractor provides a declaration opting them out.

    Workplace Pension

    Pension Auto Enrolment

    Pegasus Staff Services Ltd operates auto enrolment in accordance with the Workplace Pension Scheme (WPP) legislation. We use the government recommended WPP provider which is called Nest.

    After a postponement period of 90 days after you start work, you will be auto enrolled from the first week when your earnings exceed £192 per week.

    We operate a Qualifying Earnings scheme which means that all your earnings... basic pay, overtime and holiday pay are used to calculate your WPP contributions, less the weekly threshold which for this year is £120.

    For example, if you work 40 hours at £12 per hour and do 5 hours overtime at £18 per hour then your gross earnings are £570. Your WPP contributions will be based on £570 less the weekly threshold of £120 which gives a qualifying earnings figure of £450.

    What you will pay...

    4% will be deducted from your net pay. Your contribution will attract tax relief which will mean a total contribution of 5%. In the example above, this would amount to a deduction from your net pay of £18.00.

    What we pay...

    We pay 3% of your qualifying earnings figure so in the example about this would amount to £13.50. These amounts will appear in your Nest account and are credited in the third week of the following month.

    You have the right to opt-out within a six-week period of being auto-enrolled and any contributions paid up to that point would be returned to you. This opt-out can only be carried out by you directly with the provider Nest.

    Conditions of Employment

    Conditions Of Employment For The Temporary Worker

    1. Pegasus Staff Services Ltd t/a Pegasus (the Company) operates both as an employment business and an employment agency and offers a contract of services to:- {{customer_name}} (the Worker) as a {{job_type}} where such a suitable assignment exists at a minimum hourly rate of £ 11.44 (for 21 years old and over)
    2. The company undertakes to pay the Worker whether or not it has received payment of the Hirer. The Company will deduct from gross pay such deductions as required by Law in respect of National Insurance contributions, PAYE or any other contributions an employer is required to deduct. Any Worker who has declared himself to be self-employed must provide regular invoices representative of the services provided and the amount due for those services. Self-employed contractors must indemnify Pegasus against claims arising from the non-payment of National Insurance Contributions and Tax as may be assessed by the HMRC and from additional liability which arises, due to changes in legislation. A VAT registered Worker must provide a VAT invoice with a clearly marked VAT registration number before any payment can be made.
    3. Due to the nature of the work offered, no guarantees can be given as to the length of time a worker may be required. However, the Company will endeavour to indicate to the Worker the expected duration of a contract so far as is reasonably possible.
    4. Payment is made weekly in arrears and is calculated from a signed timesheet or information provided by the customer which verifies the total hours worked. The Worker is responsible for ensuring that all such timesheets and information are returned to the Company by 0900hrs on the Monday following the week worked. Failure to do so will result in a delay in the issue of wages.
    5. The Company will endeavour to issue wages on the Friday following the week worked subject to timesheets being returned on time.
    6. The Worker may be offered different assignments from time to time and on accepting such an offer will be required to:
      • comply with any reasonable requests of the client company or of the Company
      • not engage in any action detrimental to the client company or to the Company.
      • Conform with general and specific Health and Safety regulations in force at the place of employment
      • Comply with any security and disciplinary regulations as required and consent to be searched if necessary.
    7. The Worker will have the right to present any grievance regarding their employment to a Director of the Company.
    8. The Worker must immediately inform the Company of any changes in either personal circumstances or qualifications or licences, which may affect their ability or legal entitlement to do the work provided by the Company.
    9. The Company or the Worker can terminate this contract of services without notice.
    10. The holiday year begins on 1 st January and ends on 31 st December, during which the Worker will accrue 0.12 of a day per day worked up to a maximum of 28 days in a calendar year. Holidays must be requested with at least one week’s notice.
    11. The information supplied by yourself in this Registration Form must reflect a true and accurate account and any changes must be notified to Pegasus Staff Services immediately. Any information withheld or found to be inaccurate could result in the termination of your employment.
    SPECIAL CONDITIONS FOR DRIVING STAFF
    • All drivers must ensure that their Driver’s Licence, DQC and Driver’s card are carried with them at all times whilst working for the Company and will be made available if required for inspection by the client Company.
    • Any changes to the details on a driver’s Licence must be reported immediately to the Company.
    • Drivers must comply with all Road Traffic regulations and regulations specific to driving hours.
    • Drivers must refuse to use equipment or perform tasks, which they believe to be in contravention of Road Traffic regulations or Health and Safety legislation. Any such instances must be reported immediately to the Company.
    • Drivers must comply will all requests from the Company or the client company or any other authorised organisation for information relevant or otherwise to their work.
    • Drivers must ensure that their conduct at all times is in accordance with the requirements of Health and Safety legislation and complies with the reasonable demands of the Company and the client company.
    • Drivers must ensure that the hours they work are compliant with the requirements of the Working Time Directive. It is the responsibility of the driver to report to the Company any hours worked elsewhere which may affect the driver’s qualification to drive legally under the WTD
